Benefit Fraud and Divorce


 

Here is an example of a typical enquiry we get, with obviously all details removed to reserve strict confidentiality.

I want divorce ,he does not give me money. I had the compensation 2011

I need more information than this. Please start telling your story from the start of your claim.

 

  1. Why did you start claiming?
  2. What does the relationship with the father of your children look like? Are you married? If you are why are you not divorced? Does he support you financially?
  3. When did you receive the compensation of £13,000 and why?
  4. Please explain your sisters money in your account.

 

Please take your time to do this, you are not in a rush.

am innocent because i did not know that i need to tell the job center about my compensationin 13000 . i only told them about my another account that i open through the internet and my help to my sister who i out the uk and some times she send me money to buy her stuff and send her. she send me around 10000. that is all i can think abaut i live with my childern . my family want me to come back to him

I have received your documents and the first instalment for the mitigation package. Please follow the instructions below.

Just pretend we had caught up in the pub, and you tell me that you had got into a terrible mess and were being accused of a benefits fraud.

I, a friend, say to you ‘that amazes me, what happened, why are they accusing you of this?’

Now in your own words, on no more than one page of A4, in a word document, tell me why you think it is that they have accused you of this and what your defence is? We need the full story and are here to help you.

In your own words just tell me what you would tell the judge if you were by yourself in court without my help. Tell me why they have got things wrong and why you are innocent.

There are two further things to do, that can help you.

  1. Medical Report

If you have suffered from poor health, especially around the time of the accusation, we will require a medical report from your GP. Could you please list your symptoms in an email, if you have been unwell and, in particular, are under medical treatment now, please let me have the name and address of your doctor, together with the fax number and email address.

I will then write to the doctor for a report which you have to authorise and pay for, but it should not be much.

 

  1. References

 

I want character references as to your honesty. Also I am concerned with the sort of person you are.  The sort of person that would be a good neighbour would help with babysitting without being asked.  The sort of person, who helps old ladies across the street i.e. a thoroughly nice person who anyone would be proud to have in the family.

 

A work reference saying how hard you work, and that you are reliable and trustworthy, would also be most helpful. The references need to be typed, hand signed, and dated.

 

I attach templates of the sort of letters that might help, although everybody should write in their own words.  You should get (say) five of these letters and send them to me by post Pdf/email or fax.
